These Terms of Service ("Terms") govern your use of the fleet management and vehicle inspection services provided by Master Specialists LLC ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.
1. Services Description
Master Specialists provides commercial fleet maintenance, DOT inspection, and vehicle repair services, including:
- Pre-trip and post-trip vehicle inspections
- DOT annual inspections and compliance services
- Fleet maintenance and repair services
- Digital fleet management platform
- Estimates, invoicing, and payment processing
- Driver communication and notification services
2. Account Registration
To access our services, you may need to create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
3. Service Estimates and Pricing
- All repair work requiring approval will be preceded by an estimate
- Estimates are valid for 30 days unless otherwise specified
- Actual costs may vary from estimates if additional issues are discovered
- Any significant changes will be communicated and may require additional approval per your account settings
- Parts pricing is subject to availability and market conditions
4. Payment Terms
- Payment is due upon completion of services unless other arrangements have been made
- We accept major credit cards, ACH transfers, and checks
- Late payments may incur interest at the rate of 1.5% per month
- We reserve the right to suspend services for accounts with outstanding balances
- All prices are in US dollars
5. Warranties and Guarantees
- All repair work is guaranteed for 90 days or 6,000 miles, whichever comes first
- Parts warranties vary by manufacturer and are passed through to the customer
- Warranty claims must be reported within the warranty period
- Warranties do not cover damage from accidents, misuse, or normal wear
6. Vehicle Authorization
By requesting service, you authorize Master Specialists to:
- Operate the vehicle as necessary for inspection and repair
- Store the vehicle on our premises during service
- Photograph the vehicle for documentation purposes
- Contact authorized representatives regarding service decisions
7. Customer Responsibilities
You agree to:
- Provide accurate vehicle and contact information
- Respond to estimate requests in a timely manner
- Retrieve vehicles promptly after service completion
- Maintain appropriate insurance on all vehicles
- Disclose known vehicle issues or hazards
8. Limitation of Liability
- Our liability for any claim is limited to the amount paid for the specific service in question
- We are not liable for incidental, consequential, or punitive damages
- We are not responsible for pre-existing vehicle conditions not disclosed
- We are not liable for delays caused by parts availability or circumstances beyond our control
9. Abandoned Vehicles
Vehicles not retrieved within 30 days of service completion notice may be considered abandoned. We reserve the right to:
- Charge storage fees of $50 per day after the first 7 days
- File a mechanic's lien for unpaid services and storage
- Dispose of the vehicle in accordance with North Carolina law
10. Intellectual Property
All content, software, and materials on our platform are owned by Master Specialists or our licensors. You may not:
- Copy, modify, or distribute our content without permission
- Reverse engineer our software or systems
- Use our trademarks without written authorization
11. Termination
Either party may terminate the service relationship at any time. Upon termination:
- All outstanding balances become immediately due
- You may request export of your data
- We will retain records as required by law
12. Dispute Resolution
- Any disputes shall first be addressed through good-faith negotiation
- If negotiation fails, disputes will be resolved through binding arbitration in North Carolina
- These Terms are governed by the laws of North Carolina
- Any legal action must be filed within one year of the event giving rise to the claim
13. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through our platform. Continued use of our services after modifications constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
